Caregivers

A caregiver in the state of Montana is called a provider. A provider is an individual who is designated optionally by a cardholder (Patient) to cultivate or assist the patient with medical marijuana. A provider can also be a registered cardholder who can cultivate or grow and consume medicinal marijuana on his own.

The new law requires a cardholder to either personally grow or to select a provider, but not both. Cardholders are not allowed to provide marijuana to any person unless the cardholder is also registered as a provider, and the recipient is registered as that cardholder’s patient. Minors are required to have a different application and a permission from a parent or guardian who can serve as the provider, and a recommendation for a second physician in any case of condition.

Requirements

  • Must be at least 18 years of age and above.
  • Must not have been convicted of a felony drug offense.
  • Must be registered with the Department of Public Health and Human Services.

Becoming a Caregiver

  • The Cardholder needs to be certified for the medicinal use of marijuana with the registered physician’s recommendation.
  • The Cardholder needs to designate the Provider as his personal provider by sending a letter/application to the Department of Public Health and Human Services (DPHHS)
  • The Cardholder and the provider will both have a registry identification card to possess and cultivate marijuana which is required to possess at all times.
  • For the provider to cultivate in the cardholder’s location or residence, this must also be on the application.If using a rental space, an approval letter from the landlord must be obtained.
